MIAMI (AP) -- The lead prosecutor in the assault case against Washington Redskins safety Sean Taylor stepped aside Wednesday after defense lawyers charged that he was using his prominence in the case to promote his moonlighting work as a nightclub disc jockey.

Michael Grieco, the assistant state attorney handling the Taylor case, asked to be replaced because "he sees himself becoming the courtroom focus, rather than the individual charged with the criminal offense," said a statement from the office of his boss, Miami-Dade State Attorney Katherine Fernandez Rundle.

The move came a few hours after Taylor's attorney Richard Sharpstein said he would seek dismissal of the charges because of "inappropriate and unethical" prosecutorial conduct by Grieco, who had posted news articles about the Taylor case on a Web site that promotes his side business as a DJ in Miami Beach clubs.

"It's obvious he's exploiting his job as a prosecutor for private gain," Sharpstein said. "It has clouded his view of justice."

After being told of Grieco's departure from the case, Sharpstein said: "Now we look forward to a fair and impartial prosecutor looking at this matter and doing the right thing, which is to dismiss this case."

Grieco should be disciplined by the State Bar for his conduct, if all of those allegations are true! Don't be surprised if he's even fired (which may be the least of his worries).

All in all, I think this bodes well for the Taylor defense team.

Prosecutor #1 backed himself into a corner whereby he had to act a certain way to save face.

Prosecutor #2 has no such worries. He/she may handle this case any way the see fit without losing face. Maybe an outright dismissal wouldn't be out of the question now.

This does not surprise me one bit. Grieco is not the most popular guy here in South-East Florida. By the way, Sean is still "the man" down here and people still love him.

It's a game of poker, Greico saw it was Sean Taylor and jumped all over it. Now we have a table full of chips and Sharpstein is raising the stakes. First it was simple assault with a handgun, Taylor could deal with that but then Greico pushed to the point where Sean is facing 46 years. Sean couldn't handle that so he (or someone else) brought Sharpstein and he sat down at the table. When he ante'd up he was shot down by Mary Barzee (Miami-Dade Circuit Judge -AKA the dealer) on the "thugs and criminals are the only complainants in this" argument. BTW: Greico resigned today so now it's on Miami-Dade County State Attorney Katherine Fernandez Rundle to either drop this or pass it on to another ADA (I'm sure they are lining up to get this one........not)

The case as been moved back almost a month, the alleaged victims and their buddi.. I mean the witnesses will have plenty of time to go out and get locked up again.

I'll say it again ... I don't see it going to trail.

I have to say that in my opinion, the prosecuting attorneys on the ST case are a real joke. I thought I had seen it all, but this is a new one. If the Dade County D.A.'s office were smart, they would just let this one go. After all, according to the news (and assuming that the news is somewhat correct), most of the "innocent victims" are or were in jail, some on similar charges of theft. That in its self does not make a jury very trusting of their testimony or present a picture of the "innocent victim" and now the prosecuting attorney as a DJ advertising this case on the internet to bolster his popularity after he failed to notify the defendents attorneys of the "innocent victims" arrests. I got to show this to the judge tomorrow so he can have a good laugh also.

Did the dude actually "resign" from his job as a DA or did he merely give up on this particular case?

It could also work the other way around. Prosecutor #2 may actually be an agressive professional trying to make a name for himself in this trial. I hope that the evidence persuades him/her that there is no case but I doubt it.
Daniel Snyder has defined incompetence, failure and greed to true Washington Redskins fans for over a decade and a half. Stay away from football operations !!!

ST's gotta walk.

It just seems everything is going as well as it could go (without being dismissed completley).

Hopefully Sean will be completley cleared by mini camp.

I'm surprised that it took this long to mention his DJ name ROTFALMAO

Sean is at the "voluntary" work outs so his counsel must be very confident on how this case is progressing.

Grieco created all this attention with his grand standing... now he's running scared and trying to get his face out of the limelight so he doesn't lose his job... bad thing is the prosecution may now feel they have to do everything in their power to prove ST guilty and that the rest of this hooplah was just a sideshow created by the defense... that's the only way Grieco's boss saves face... either that or they make Grieco the total fall guy, fire him, and drop the case... doesn't sound like they're doing that though...

The bad thing about being a prosecutor, and one of the reasons I am no longer one, is this whole feeling of "looking/acting tough" instead of "doing the right thing."

"Doing the right thing" is tough and does not always capture public approval, which many prosecutors strive to achieve for some warped reason.

We'll see.

I found a rather unbiased, straight forward RECAP of the whole situation.

When his rookie season ended, Taylor chose to return to his native Miami rather than stay in Virginia near the Redskins. He sometimes stayed with friends, including Michael McFarlane, who lived in West Perrine, according to Carhart, Taylor's lawyer.

With money from a seven-year, $18 million contract, Taylor bought a pair of all-terrain vehicles. Four-wheel A.T.V.'s are popular in West Perrine. They can be seen on weekends buzzing down side streets and traversing the yards of housing projects.

On May 31, 2005, after cruising West Perrine with a friend, Taylor parked his new A.T.V.'s at McFarlane's house. Taylor left the vehicles overnight, though he did not stay at the house himself, according to Carhart.

The narrative of what followed, including Taylor's arrest, is laid out in the felony records room of the Richard E. Gerstein Justice Building in Miami. Two folders bulge with the incident report, lawyers' motions and a dozen depositions of witnesses and police officers.

When McFarlane awoke June 1, he discovered the A.T.V.'s were missing, according to Carhart. He and a friend, and then eventually Taylor, drove around the neighborhood looking for the vehicles, according to the police report.

The reports said that Taylor's blue Yukon Denali cruised several times past a house where Ryan Hill was hanging out with friends. Hill approached the vehicle to ask Taylor what he wanted.

"He started talking nasty and stuff, talking about how: 'The police can't touch me. I own this town,' " Hill, 22, said in an interview on the stoop outside his mother's public-housing apartment in West Perrine, where he lives with her, a brother and a sister.

According to Hill and other witnesses, Taylor exited his truck, pulled a gun out of his waistband and pointed it at Hill and a couple of his friends. Witnesses said another man pulled out an M-16 and demanded that Hill return Taylor's A.T.V.'s. When Hill denied stealing the vehicles, Taylor and the other man left in their cars. Both vowed to return and kill everyone present, according to depositions from Hill and other witnesses.

Ten minutes later, Taylor did come back, this time with what has been labeled in the police report as "a posse" of men in other cars. He confronted Hill and his friends.

Hill, a 6-foot-3, 273-pound former high school football star, said in the interview that Taylor was "just jumping up, like in a football game. He was just jumping up, like hyped. Then he just swung at me when he got across the street. I fought him back."

The fight broke up when Hill and his friends scattered. Taylor returned to his Yukon and drove back to McFarlane's house, several blocks north. He parked the truck in front of the house, which he entered. A silver car pulled up. Hands poked out of the car's windows. From inside the house, McFarlane noticed guns and dived to the floor, according to depositions given by witnesses to Taylor's lawyers.

The Yukon was struck at least 15 times, and the police recovered 27 bullet cases, according to the police report.

Taylor was not at the house when the police arrived. McFarlane and others refused to allow the police to search the house, according to officers.

Three days after the shooting, Taylor surrendered at a police substation near West Perrine. He posted $16,500 bond and was released. He has pleaded not guilty to all charges against him.

Days before the trial was scheduled to start this week, Taylor's lawyers found that the prosecutor, Michael Grieco, had put newspaper clippings from the case on his Web site to promote his other job as a D.J. Grieco stepped down, and the trial was postponed until May.

That's odd, I'm looking at it now (or at least I think I'm on the right page, followed the link from the site linked a few pages back), there's a video of a kid (or someone that looks like a kid) dancing around and cursing. It is really hard to read, the page is black and the font is dark red.

I checked the wayback machine but it isn't there.

Who threatens someone with an assault rifle?
The guy should have told the police that Taylor also pulled out his RPG and threatened to blow up his house.
