Please keep your fingers crossed!

Scott and I are about to leave for court. The kid who hit us plead not guilty to Reckless Driving so we have to go testify against him. He had claimed he had a witness saying Scott didn't stop at the stop sign but he failed to present this witness to his insurance company so I'm assuming that he won't materialize in court either. Our insurance companies are fighting and are awaiting today's outcome to proceed. We know the kid is at fault but we could use as many crossed fingers as possible to make sure that justice is served. Our lawyer told us that sometimes they proceed to trial only to see if the victims bother showing in court. And if they do the defendant just pleads guilty. We're hoping that's what happens because this incident has already caused us enough grief and heartache, and for something that was not our fault.

Your lawyer is correct on this one, 100%. My bet is once this knucklehead sees you in Court, the "State" will likely offer him a plea that he will accept. If your State has a "Victim's Bill of Rights" the prosecutor should talk to you before offering the plea to get your "stamp of approval", not necessarily "permission".

There was no plea, mostly because the Town Attorney and the cop wanted to nail this kid. After my testimony and the police officer's, they didn't even call Niki. We had to sit outside so that we couldn't match our testimony, but the defendent apparently contradicted his own testimony, and his own lawyer rejected his witness because they were friends. The judge decided he was guilty of improper driving and not reckless driving because he stopped and looked both ways before he plowed into us. :hmm:

In any case, he was found at fault, which means his insurance company can pay back ours (and by proxy us for our deductible and rental car fees). Once Niki is finished with Physical Therapy, we can go for our medical expenses. In Virginia, even if you pay for the bills with your health insurance, the car insurance has to pay for the ful price of the procedures.

Thanks everyone. Scott and I are going to sleep very well this evening. Just one word of advice if you are ever in our situation try to make sure the person that hits you has a last name at the begining of the alphabet. We sat through a bunch of cases before we got to ours. And when we got to ours the kid stood in front of the judge in shorts. I was so surprised that, that didn't make the judge throw his ignorant butt in jail just for that.

We are almost through this. The insurance companies are now able to proceed and because of his finding of guilt it will be smooth sailing. Thank goodness.
